Can you actually drill a well on Hill Country land around Dripping Springs right now? For a meaningful share of parcels, the honest answer this month is no, or at least not without a fight. That single fact rearranges the entire due diligence sequence for anyone shopping acreage in western Hays County, and it is the piece almost nobody checks before they write an offer.

Most land buyers walk into an option period assuming the two big infrastructure questions, septic and water, are just a matter of hiring the right contractor. Around Dripping Springs, both questions run through public agencies with rules that change based on drought conditions and where exactly your parcel sits relative to the Edwards Aquifer. The price per acre gets all the attention. The permitting reality underneath it is what actually determines whether a tract is buildable on your timeline.

The 10-acre exemption everyone repeats, and the catch nobody mentions

Ask around and you will hear a version of this: buy 10 acres or more, and you are exempt from needing a septic permit. That is close to true, and also incomplete in a way that matters.

Texas rule 30 TAC 285.3 does allow an exemption from the standard septic permit for a single-family home on a tract of 10 acres or more, as long as it is the only dwelling on the tract, the system sits at least 100 feet from every property line, effluent stays on the property, and the system does not create a nuisance or pollute groundwater. Even then, the tract still needs a site evaluation and the system still has to meet state design standards. It is an exemption from the permit process, not from having a functioning, code-compliant system.

Here is the part that changes the math for a lot of Dripping Springs land: much of northern Hays County sits over the recharge zone or contributing zone of the Barton Springs segment of the Edwards Aquifer, and that boundary is specific to each parcel. Even for parcels that clear the permitting hurdle, the physical water picture has gotten worse. A March 2026 report from Austin's NPR station, KUT, quoted Jared Thompson, owner of local well-servicing company The Well Doctor, describing water levels in the Wimberley and Dripping Springs area now sitting around 660 to 690 feet down, compared to roughly 500 feet after a healthy rain year in the past. The district told KUT that aquifer and river conditions have not been this poor in its more than 20-year history, including the 2011 drought, and that as of March 2026, 100 percent of its monitored wells were reading below their historic levels. The district's own drought outlook data puts the odds of enough rain to end the drought within six months at under 1 percent.

None of that means land near Dripping Springs is unbuildable. It means the well question needs a direct answer from the district and from a licensed driller before you get deep into a contract, not a general assumption that rural Texas land always comes with reliable groundwater.

  • Ask the seller for their agricultural exemption history if the land carries a 1-d-1 valuation, since eligibility depends on documented use, not assumption.
